Terms & Conditions V13 August 2023

To enrol at Wise Owl Education, you will be required to complete our enrolment process which includes agreeing to abide by and adhere to the conditions below and to read our Privacy Policy.  

PLEASE NOTE IMPORTANT POINTS BELOW 

  • Parents are invoiced termly in advance for their children’s lessons. 
  • If a lesson is cancelled by Wise Owl Education, the parent will be offered either a refund for that class or an alternative class if possible (the choice will be at the parent’s discretion). 
  • If a student cannot attend a lesson for any reason, the parent can request a catch-up lesson if one is available. All catch-up lesson requests will only be granted at the discretion of Wise Owl Education and must be taken within the current teaching term preferably within the same week or on the weeks either side of the missed lesson. Missed lessons may not be carried over to new terms and will not be refunded.  
  • Parents must inform Wise Owl Education at least 4 weeks before the end of term that they intend to stop their lessons at the end of that term. A notice to leave email will be sent out with a reminder date. This date will be 4 weeks before the end of the teaching term. Notice must be received before or on the deadline date to avoid being charged for the following term. 
  • If a payment due to be taken by direct debit fails due to the direct debit being cancelled by the Parent/Guardian of the Pupil, the Centre reserves the right to charge a £25 admin fee to reinstate the direct debit and associated admin to reactivate the account.  The Centre also reserves the right to charge the admin fee on each occasion that the payment fails.  
  • Pupils are permitted to play at the Centre for a maximum of one hour only free of charge. This will be either one hour before or one hour following the lesson, but this is strictly dependent on the lesson time. If your lesson starts after 5pm weekdays, 11am or 12pm on a Saturday or Tues-Fri at 2pm your play must be taken before your lesson. Siblings of children attending one of our lessons may play for free while their sibling is attending their lesson with prior consent when enrolling.

1. DEFINITIONS

In these Terms and Conditions, the following expressions have the following meaning:

Centre: The school location

School: Wise Owl Education (‘Parents Paradise Ltd’ trading as ‘Wise Owl Education)

School Head Office:

Fees: The School’s published fees which cover tuition fees only.

Pupil: Any child enrolled at Wise Owl Education.

Head: Head of Education at Wise Owl Education.

Parent: The signatory or signatories to the enrolment form.

Rules & Policies: Rules of Play, policies and procedures and regulations at the location.

Term: The Academic Term at Wise Owl Education (which will vary from year to year & location).

2. AGREEMENT

(a) A legally binding Agreement is made upon the registration of the Pupil. For avoidance of any doubt, the contract arising upon registration is made between the School and the Parent by completion of an enrolment form. Where that form is completed referencing more than one party, then the responsibility of those parties is joint.

(b) In entering into the Agreement, the Parent agrees that they and the Pupil will:

i. Be bound by the Centre’s Rules and by these Terms and Conditions; and

ii. Support the Centre & School in maintaining its good standards of behaviour and discipline and adhere to the code of conduct.

(c) The rights of the Centre under this Agreement will not be waived even if these Terms and Conditions are not enforced.

3. THE CENTRE’S RULES OF PLAY

(a) When entering the Centre, Pupils and Parents are bound by the centres Rules of Play which include:

  • Parents/guardians must supervise children at all times.
  • The Centre staff are there to assist you, not to take responsibility for your child.
  • Height and age restrictions are in force for the safety of all children, and Centre staff will enforce them.
  • Children & Adults must remove their shoes before entering the playframes, (socks or tights must be worn).
  • No food, drinks, sweets or chewing gum are allowed on the playframes.
  • The Centre does not accept any responsibility for theft or loss of personal items whilst on the premises (lockers are available).
  • Customers are not permitted to consume their own food or drink on the premises.
  • In the event of an emergency, the Centre staff will evacuate the playframes and classrooms and children will be taken to the assembly point in line with the Centre’s procedures.
  • No additional siblings, guardians/parents will be admitted to Parents Paradise other than those agreed at enrolment (due to capacity restrictions).

(b) Pupils are permitted to play at the Centre for a maximum of one hour only free of charge. This will be either one hour before or one hour following the lesson, but this is strictly dependent on the lesson time. If your lesson starts after 5pm weekdays, 11am or 12pm on a Saturday or Tues-Fri at 2pm your play must be taken before your lesson.

 

(c) If you are permitted to remain in the building after the Centre closes to the public, the play frames will be closed and unsupervised and therefore any parents who allow their children to play in the Centre do so at their own risk and must retain full responsibility for them.

(d) Parents/guardians must remain in the Centre whilst Pupils attend their lessons.

4. FEES

(a) Fees payable to the School cover the cost of providing the lesson only.

(b) Fees are payable termly in advance by Direct Debit. The due date of your fees will be detailed on your invoice. We do not accept cheques or cash.

(c) An advertised free lesson is only applicable upon enrolment and is deducted from the first term’s fees.

(d) It is your responsibility to inform us of any changes to your billing or contact information.

(e) Your invoice will be divided into two parts, one payment will be taken on the first of the month before the end of a term, with the second being taken at the beginning of the following month. These payment dates will be specified on your invoice. There is the option to pay your invoice in one termly payment. Please bear in mind that Spring term payments may not be made on the 1st of the month due to bank holidays.

(f) If payment is not received by the first day of the Term, the School will suspend its provision of services. However, this does not release you from your contractual obligations.

(g) No reduction will be made from the Fees where teaching is reduced because of exclusion, in accordance with clause 8, or matters outside of the control of the School. If the School has to close temporarily due to an emergency, the Term will not be extended.

(h) The School reserves the right to increase Fees annually.

(i) If a payment due to be taken by direct debit fails due to the direct debit being cancelled by the Parent/Guardian of the Pupil, the Centre reserves the right to charge a £25 admin fee to reinstate the direct debit and associated admin to reactivate the account. We reserve the right to charge this fee for each subsequent failure.

5. REFUND POLICY

(a) No refund of the School Fees shall be due in the event of non-attendance by a Pupil. Lessons will not be repeated. However, the resources used in that lesson will be made available (where possible) to the student upon request.

(b) If the Centre fails to provide a lesson due to teacher absence your lesson will be refunded.

(c) In the case of severe weather conditions, lessons will continue unless Parents are contacted directly by the School/Centre to cancel lessons.

6. PARENT’S AUTHORITY

The Parent authorises the teacher (while in loco parentis) to take or authorise in good faith all decisions affecting the welfare of a student. Parents’ consent to such physical contact with a Pupil as may be lawful, appropriate and proper for teaching and to provide comfort to a student in distress or to maintain safety and good order.

7. NOTICE PERIOD

a) Before the end of term, Wise Owl Education will write to parents to give them a date to inform the School of the parent’s intention to stop the lessons. This date will be 4 weeks before the end of the teaching term. Notice must be received before or on the deadline date to avoid being charged for the following term.

b) If written notice is not received by the specified date, the Parent’s Direct Debit will be taken for the following term. This payment is non-refundable.

c) Written notice must be received and acknowledged in writing by the Wise Owl team prior to the cut-off date. The Parent must contact the School promptly if no such acknowledgement is received.

8. EXCLUSION

(a) The Pupil may be excluded for a fixed period of time and/or permanently excluded for:

i. A breach of Centre Rules and/or code of conduct;
ii. Non-payment of Fees; or
iii. If the Parent’s behaviour is unreasonable and is likely to adversely affect the Pupil or other Pupils or staff at the School/Centre, or to bring the School/Centre into disrepute.

(b) In all cases of exclusion, full Fees will remain payable for the Term in which it occurs.

(c) A Pupil who has been withdrawn, excluded, suspended or expelled from the Centre has no right to enter the Centre premises without prior consent.

9. MEDICAL

a) The Parent must supply all details of the Pupil’s medical history and/or allergies to the Centre and must notify the Centre immediately if there are any changes to the information supplied.

b) The Parent grants the teacher (or the person with responsibility for the Pupil at the relevant time) full authority to give consent to the carrying out of any emergency medical treatment or anaesthetic certified by a medical practitioner to be necessary for the Pupil, if the Parent cannot be contacted immediately by the Centre/School.

10. PARENTAL RESPONSIBILITY AND COURT ORDERS

(a) The Parent will notify the Head or location manager immediately of any parental responsibility agreement or court order relating to the Pupil (e.g. residence, contact, prohibited steps or other specific issues) and send the Head a copy of the same. In the absence of any such court order, the School will treat each person with parental responsibility as having equal rights to receive relevant information about the Pupil on request (unless in the Head’s discretion it is not in Pupil’s best interests to do so).

(b) In signing any form of consent requested by the School, the Parent is responsible for ensuring that all other consents required by law have been obtained.

(c) Parents are responsible for the Pupil’s welfare within the Centre/location at all times except when the child is in lessons.

11. COMPLAINTS

In the event of a complaint which the Parent is unable to resolve satisfactorily with the school, the Parent must put the complaint in writing to the School.

12. INSURANCE

(a) Pupil’s personal property is not covered by the Centre’s insurance when on Centre premises. The Centre accepts no responsibility for loss or damage to Pupil’s personal property whilst on the Centre premises.

(b) Please notify the Centre directly in cases of liability in respect of third-party bodily injury

13. COPYRIGHT AND DATA PROTECTION

(a) Personal data provided by or relating to Parent or Pupil will be used by the School for the purposes of fee billing and collection; maintaining Pupil records; as required in connection with provision of a Pupil’s education; statistical analysis; market research and communication.

(b) With prior written consent only from the Parents, a Pupil’s details may be used in our marketing materials including the Pupil’s first name and details of educational achievements. A Pupil’s photo may also be used in our marketing materials. We may also use video footage including your child. If you do not wish your child’s details or photos, or video footage including your child to be used in such a way, then please notify the School when such a proposal is discussed.

(d) All study materials are protected by copyright law. Wise Owl Education Ltd is the licensee of all intellectual property rights for all published materials, books and resources and these remain the property of the owner of the copyright licence Wise Owl Education Ltd. You acknowledge that you must not modify, copy, distribute or reproduce any of the published materials or website content.

14. DAMAGES

(a) Pupils and Parents are jointly liable for any damage caused by them to the Centre/School property, any assets and equipment.

15. GENERAL CONDITIONS

(a) The School reserves the right to make reasonable changes from time to time to the standard Terms and Conditions, to the size and location of the School, to its premises and facilities, to the academic and extra curriculum, the structure and composition of classes, the way the School is run, to the length of the School’s terms and to any other aspect of the School.

(b) Dependent on the Centre; siblings of children attending Wise Owl Education maybe allowed free admission on a play only basis. No other concessions will apply.

16. VARIATIONS OF THE TERMS AND CONDITIONS OF THE AGREEMENT

(a) The offer and acceptance of a place are made on the basis that any successful School needs to develop and that the School may make reasonable changes to these Terms and Conditions as they see fit.

(b) Guardians or Parents will inform the School promptly of any changes to the details contained in the Enrolment Form.
